Terms of Service

These Terms of Service ("Terms") govern your use of PlotStudio AI ("the Service"), a desktop application for agentic data analytics operated by AR5 Labs("we", "us", "our"). By downloading, installing, or using PlotStudio, you agree to be bound by these Terms.

1. The Service

PlotStudio AI is a desktop application that provides AI-powered data analysis. The Service includes the desktop application, associated cloud services (account management, billing, AI query routing for Managed Credits), and any updates or patches we provide.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will make commercially reasonable efforts to notify you of material changes in advance.

2. Account & Eligibility

You must be at least 16 years old to use PlotStudio. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate account information and to update it as needed.

If you are using PlotStudio on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Your Data & Ownership

Ownership

You retain full ownership of your data. This includes all datasets you upload, queries you make, analysis results, generated code, visualizations, and exported reports. We claim no ownership or intellectual property rights over your data or the outputs generated from it.

Local Processing

Your data files are processed locally on your machine. We do not upload, store, or access your data files on our servers. See our Privacy Policy for details on how AI queries are handled under Managed Credits vs. BYOK mode.

4. AI-Generated Content

Output Ownership & Limitations

PlotStudio uses AI models (provided by OpenAI) to generate code, analysis, narratives, and visualizations. You own the outputs generated from your data and queries. However, you acknowledge that:

  • AI-generated outputs may contain errors, inaccuracies, or biases. You are responsible for reviewing and validating all AI outputs before relying on them for decisions.
  • Similar inputs may produce similar outputs for different users due to the nature of AI models. AI-generated content may not be protectable under intellectual property laws in all jurisdictions.
  • We do not use your inputs or outputs to train AI models. In Managed Credits mode, queries pass through our infrastructure for billing purposes only.
  • AI-generated analysis should not be treated as professional advice (legal, medical, financial, or otherwise). Always consult qualified professionals for critical decisions.

5. Plans & Billing

Managed Credits

Managed Credits plans provide a set allocation of AI credits. Credits are consumed based on query complexity and AI model usage. Unused credits do not roll over between billing periods unless explicitly stated in your plan. Pricing and credit allocations are published on our Pricing page and may be updated with 30 days notice.

BYOK (Bring Your Own Key)

BYOK plans require you to provide your own OpenAI API key. You are responsible for all costs incurred through your API key with OpenAI. PlotStudio charges a separate subscription fee for access to the platform. Your API key is stored locally on your machine and is never transmitted to our servers.

Free Trials

Both plans include free trial options. No credit card is required to start a trial. At the end of the trial period, you may choose to subscribe or your access will be limited. We will not charge you without your explicit consent.

Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods. If you believe you have been charged in error, please contact us.

6. Acceptable Use

You agree not to:

  • Use PlotStudio for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse-engineer, decompile, or disassemble the application
  • Circumvent or disable any security or access-control features
  • Share your account credentials or allow unauthorized access to your account
  • Use the Service to generate content that is harmful, misleading, or violates third-party rights
  • Resell, sublicense, or redistribute the Service without our written permission
  • Intentionally overload or disrupt the Service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Intellectual Property

License Grant

PlotStudio AI, including its source code, design, branding, documentation, and AI agent architecture, is the intellectual property of AR5 Labs. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the application for its intended purpose during your active subscription.

Restrictions

This license does not grant you ownership of or rights to the underlying software, models, or infrastructure. You may not copy, modify, or create derivative works of the application itself.

8. Third-Party Services

Service Integrations

PlotStudio integrates with third-party services including OpenAI (AI models), Stripe (payments), and Clerk (authentication). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.

BYOK & OpenAI

In BYOK mode, your use of the OpenAI API is governed by OpenAI's Terms of Use. OpenAI states that API data is not used to train their models.

9. Disclaimers

PlotStudio is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • AI-generated outputs will be accurate, complete, or suitable for any particular purpose
  • The Service will meet your specific requirements
  • Any errors or defects will be corrected within a specific timeframe

You use AI-generated analysis at your own risk. PlotStudio is a tool to assist analysis, not a replacement for professional judgment.

10. Limitation of Liability

To the maximum extent permitted by law, AR5 Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, revenue, business, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless AR5 Labs from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the application at least 30 days before they take effect. Your continued use of PlotStudio after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which AR5 Labs operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.
